A l'heure de l'inflation normative, une réflexion sur la fin du droit peut paraître paradoxale, voire aller à contre-courant des mutations contemporaines du droit. En outre, les nombreux travaux relatifs à ces mêmes mutations et aux transformations du droit ces dernières années laissent penser que le droit ne peut connaître de fin, se renouvelant en permanence pour ne jamais laisser d'espace de non droit. Sans à coup, sans coupe nette, le droit poursuivrait sa progression sans heurt. Le droit n'aurait-il donc (...) jamais de fin? L'adage "ubi societas ibi jus" plaide, à l'évidence, pour une réponse négative. Cependant, de multiples questions se posent. Est-ce qu'une norme peut vraiment cesser d'exister et si oui, à partir de quand? Le droit connaît-il un terme? Peut-il disparaître? Issu d'un colloque qui s'est tenu à l'Université de Versailles Saint-Quentin-en-Yvelines, composé de contributions de spécialistes reconnus des diverses branches du droit public, cet ouvrage offre à travers l'examen de la fin du droit un regard sur sa définition même. In a first part, I defend that formal semantics can be used as a guide to ontological commitment. Thus, if one endorses an ontological view \(O\) and wants to interpret a formal language \(L\) , a thorough understanding of the relation between semantics and ontology will help us to construct a semantics for \(L\) in such a way that its ontological commitment will be in perfect accordance with \(O\) . Basically, that is what I call constructing formal semantics from an (...) ontological perspective. In the rest of the paper, I develop rigorously and put into practice such a method, especially concerning the interpretation of second-order quantification. I will define the notion of ontological framework: it is a set-theoretical structure from which one can construct semantics whose ontological commitments correspond exactly to a given ontological view. I will define five ontological frameworks corresponding respectively to: (i) predicate nominalism, (ii) resemblance nominalism, (iii) armstrongian realism, (iv) platonic realism, and (v) tropism. From those different frameworks, I will construct different semantics for first-order and second-order languages. Notably I will present different kinds of nominalist semantics for second-order languages, showing thus that we can perfectly quantify over properties and relations while being ontologically committed only to individuals. I will show in what extent those semantics differ from each other; it will make clear how the disagreements between the ontological views extend from ontology to logic, and thus why endorsing an ontological view should have an impact on the kind of logic one should use. In the past 20 years, experimental philosophers have investigated folk intuitions about free will and moral responsibility, and their compatibility with determinism. To determine whether laypeople are “natural compatibilists” or “natural incompatibilists”, they have used vignettes describing agents living in deterministic universes. However, later research has suggested that participants’ answers to these studies are plagued with comprehension errors: either people fail to really accept that these universes are deterministic, or they confuse determinism with something else. This had led certain experimenters (...) to conclude that maybe folk intuitions about the compatibility of free will with determinism could not be empirically investigated. Here, we propose that we should refrain from embracing this pessimistic conclusion, as scenarios involving time loops might allow experiments to bypass most of these methodological issues. Indeed, scenarios involving time loops belong both to the philosophical literature on free will and to popular culture. As such, they might constitute a bridge between the two worlds. We present the results of five studies using time loops to investigate people’s intuitions about determinism, free will and moral responsibility. The results of these studies allow us to reach two conclusions. The first is that, when people are introduced to determinism through time loops, they do seem to understand what determinism entails. The second is that, at least in the context of time loops, people do not seem to consider determinism to be incompatible with free will and moral responsibility. (shrink)

The purpose of this paper is to discuss the methodological foundations of the law and economics movement, with a special emphasis on the role and place of individuals in law and economics. Reviewing the works of the main contributors—the founders, indeed—to the law and economics movement, we show that all of them considered that the analysis of legal phenomena had to start from individual behavior, even as these very behaviors were embedded, to various degrees, though not determined, in legal and (...) institutional frameworks. They all use social, systemic, institutional, and anti-reductionist individualistic methodology. This is not inconsistent or contradictory. Indeed, methodological individualism does not imply to conceive human beings as (isolated) atoms living as if they were suspended in a social vacuum. (shrink)

Face aux incertitudes et aux complexités géopolitiques du monde contemporain, elle fait le choix d’une immersion au cœur du « renseignement humain ». Cet article envisage l’hypothèse selon laquelle une telle fiction permet de restaurer la confiance des spectateurs vis-à-vis de la capacité d’une démocratie à lutter contre ce qui la menace. En (...) plongeant son spectateur dans les coulisses du renseignement, en le familiarisant avec des personnages complexes, la série questionne la légitimité de la confiance qu’il est possible d’accorder à un service de renseignement. La faillibilité des agents, mise en scène de façon détaillée, réfléchie par la série elle-même, rassure parce qu’elle permet de comprendre et de partager une forme de vie spécifique qui est celle de l’action secrète. L’espionnage, le contre-espionnage et le contre-terrorisme apparaissent alors comme des pratiques reposant en dernier ressort, non pas sur une maîtrise absolue, mais sur la décision de faire confiance ou au contraire de se méfier. Mobilisant les recherches de la sociologie contemporaine à propos de la confiance (Giddens, 1994 et Luhmann 2006), il s’agit de décrire Le Bureau des légendes comme une fiction projetant sur nos écrans, la possibilité d’une restauration de la confiance ou pour le dire à la manière de Stanley Cavell, une issue possible au scepticisme. Machine ethics is the field that strives to develop ‘artificial moral agents’ (AMAs), artificial systems that can autonomously make moral decisions. Some authors have questioned the feasibility of machine ethics, by questioning whether artificial systems can possess moral competence, or the capacity to reach morally right decisions in various situations. This paper explores this question by drawing on the work of several moral philosophers (McDowell, Wiggins, Hampshire, and Nussbaum) who have characterised moral competence in a manner inspired by Aristotle. Although (...) disparate in many ways, these philosophers all emphasise what may be called ‘moral sensitivity’ as a precondition for moral competence. Moral sensitivity is the uncodified, practical skill to recognise, in a range of situations, which features of the situations are morally relevant, and how they are relevant. This paper argues that the main types of AMAs currently proposed are incapable of full moral sensitivity. First, top-down AMAs that proceed from fixed rule-sets are too rigid to respond appropriately to the wide range of qualitatively unique factors that moral sensitivity gives access to. Second, bottom-up AMAs that learn moral behaviour from examples are at risk of generalising from these examples in undesirable ways, as they lack embedding in what Wittgenstein calls a ‘form of life’, which allows humans to appropriately learn from moral examples. The paper concludes that AMAs are unlikely to possess full moral competence, but closes by suggesting that they may still be feasible in restricted domains of public morality, where moral sensitivity plays a smaller role. The purpose of this paper is to examine how any domain of Meinongian objects can be structured by a special kind of mereology. The basic definition of this mereology is the following: an object is part of another iff every characteristic property of the former is also a characteristic property of the latter. I will show that this kind of mereology ends up being very powerful for dealing with Meinongian objects. Mereological sums and products are not restricted in any way (...) in a domain of Meinongian objects: there is a sum and a product for any pair of Meinongian objects. With the mereological operations of sum, product and complement, and two special Meinongian objects, we can define a full boolean algebra on Meinongian objects. Moreover, this kind of mereology is atomic and extensional: an atom is a Meinongian object having just one characteristic property and two objects are identical iff the same atoms are parts of both of them. A Meinongian object can finally be defined in mereological terms as the sum of the atoms of its characteristic properties. (shrink)

Prism Adaptation is a useful method to study the mechanisms of sensorimotor adaptation. After-effects following adaptation to the prismatic deviation constitute the probe that adaptive mechanisms occurred, and current evidence suggests an involvement of the cerebellum at this level. Whether after-effects are transferable to another task is of great interest both for understanding the nature of sensorimotor transformations and for clinical purposes. However, the processes of transfer and their underlying neural substrates remain poorly understood. Transfer from throwing to pointing is (...) known to occur only in individuals who had previously reached a good level of expertise in throwing, not in novices. The aim of this study was to ascertain whether anodal stimulation of the cerebellum could boost after-effects transfer from throwing to pointing in novice participants. Healthy participants received anodal or sham transcranial direction current stimulation of the right cerebellum during a PA procedure involving a throwing task and were tested for transfer on a pointing task. Terminal errors and kinematic parameters were in the dependent variables for statistical analyses. Results showed that active stimulation had no significant beneficial effects on error reduction or throwing after-effects. Moreover, the overall magnitude of transfer to pointing did not change. Interestingly, we found a significant effect of the stimulation on the longitudinal evolution of pointing errors and on pointing kinematic parameters during transfer assessment. These results provide new insights on the implication of the cerebellum in transfer and on the possibility to use anodal tDCS to enhance cerebellar contribution during PA in further investigations. From a network approach, we suggest that cerebellum is part of a more complex circuitry responsible for the development of transfer which is likely embracing the primary motor cortex due to its role in motor memories consolidation. This paves the way for further work entailing multiple-sites stimulation to explore the role of M1-cerebellum dynamic interplay in transfer. (shrink)

This article aims to present Queen Jadwiga’ actual influence on nominations for episcopal sees during her reign and joint rule with Władysław Jagiełło. Until now, except for Krzysztof Ożóg, researchers expressed only a marginal interest in the subject. The author cites relevant views contained in all major studies on Jadwiga’s reign as well as analyses all available sources, mainly printed ones, both papal documents and chronicles, with special regard to the works of Jan Długosz. Using the induction method, the author (...) analyses 22 nominations for episcopal sees. Contrary to the views expressed in the literature of the subject, Jadwiga did not influence all episcopal nominations she has been attributed with. Nonetheless, in some cases we may argue that she exerted noticeable pressure; in other instances it was probably only more or less subtle. In all analysed nominations, whenever her role was clearly proved in sources, we may notice that Jadwiga was invariably cooperative in the common ecclesiastical policy which she pursued together with her husband. For example, both took advantage of the Holy Sees’ vulnerability in the era of the Occidental Schism, which allowed them to push their own candidates for episcopal seats. The present analysis revealed that with regard to the majority of most prestigious bishoprics in the Kingdom of Poland it was Jagiełło who had key influence on candidates for episcopal nominations, building his own political power base. At the same time, certain episcopal promotions, especially those in Ruthenia, Moldova and Mazovia, were reported inadequately and in few sources, hence Jadwiga’s and Władysław’s influence on the nominations of bishops can only be hypothetically determined. SummaryThis paper proposes a reading of Thomas Aquinas’ doctrine of predestination as fundamentally oriented towards and realized in friendship with God. On this reading, the seemingly disparate questions, “What does it mean to be predestined?” and “What does it mean to grow in friendship with God?” are not only mutually illuminating but ultimately coterminous. In the first part of the paper, I contextualize this theological rapprochement by foregrounding Aquinas’ treatment in the Summa Theologiae of predestination as a Christocentric, communal reality, (...) and by considering friendship with God as the end of Aquinas’ doctrine of grace. In the second part, I attend to Aquinas’ scriptural commentaries on Romans and the Gospel of John, in order to conduct a reading of predestination in/as friendship with God. Ultimately, as invited in friendship and adopted in grace into the life of Christ, God’s ordering of the rational creature to eternal life is nothing other than God’s ordering of humanity as viator to friendship with Himself in the inner life of Trinitarian love itself. Although Strawson’s main aim in “On Referring” was to argue that definite descriptions can be used referentially – that is, “to mention or refer to some individual person or single object . . . , in the course of doing what we should normally describe as making a statement about that person [or] object” (1950, p. 320) – he denied that definite descriptions are always used referentially. The description in ‘Napoleon was the greatest French soldier’ is not used referentially, says (...) Strawson, since it is used not to mention an individual, but only “to say something about an individual already mentioned” (p. 320). This is an example of what we may call a predicative use of a definite description, though such uses might be better illustrated by considering the false sentence.. (shrink)

One reason to think that names have a predicate-type semantic value is that they naturally occur in count-noun positions: ‘The Michaels in my building both lost their keys’; ‘I know one incredibly sharp Cecil and one that's incredibly dull’. Predicativism is the view that names uniformly occur as predicates. Predicativism flies in the face of the widely accepted view that names in argument position are referential, whether that be Millian Referentialism, direct-reference theories, or even Fregean Descriptivism. But names are predicates (...) in all of their occurrences; they are predicates that are true of their bearers. When a name appears as a bare singular in argument position, it really occupies the predicate position of what in this essay is called a denuded definite description: a definite description with an unpronounced definite article. Sloat provided good evidence for this. The definite article is sometimes pronounced with names in the singular: ‘The Ivan we all love doesn't feel well’. Sloat proposed a disjunctive generalization of when the definite article must be pronounced with a singular name. This essay shows that by slightly revising Sloat's generalization, we arrive at a simple, nondisjunctive, syntactic rule that governs the overt appearance of the definite article with singular names. But Ivan does not necessarily bear the name ‘Ivan’, so one might worry that the sentence “Ivan might not have had ‘Ivan’ as a name” would incorrectly be predicted false. This essay shows that Predicativism does not have this consequence by showing that incomplete definite descriptions in general and incomplete denuded descriptions, such as ‘Øthe Ivan’, in particular are rigid designators. Each volume in the library deals with a field of enquiry which has received significant attention in philosophy in the last 25 years and is edited by a philosopher noted in that field.

In quantum statistical mechanics, equilibrium states have been shown to be the typical states for a system that is entangled with its environment, suggesting a possible identification between thermodynamic and von Neumann entropies. In this paper, we investigate how the relaxation toward equilibrium is made possible through interactions that do not lead to significant exchange of energy, and argue for the validity of the second law of thermodynamics at the microscopic scale.

Znaczenie kolegiów jezuickich w rozwoju szkolnictwa na ziemiach Rzeczypospolitej, podobnie jak wkład członków Towarzystwa Jezusowego w postęp naukowy, tak polski jak i europejski pozostają bezsprzeczne. Warto wszak zwrócić uwagę na fakt propagowania przez jezuitów wiedzy na temat Dalekiego Wschodu, misji chrystianizacyjnych prowadzonych w Indiach, Chinach i Japonii, a także społeczne, kulturowe i polityczne konsekwencje działań podjętych przez nich w tym zakresie. Szczególne znaczenie ma tutaj działalność poszczególnych kolegiów, które kształcąc na dość wysokim poziomie, stawały się miejscem wzrastania powołań kapłańskich, a (...) co za tym idzie także powołań misyjnych. Relacje i listy z krajów Dalekiego Wschodu nie pozostały bez wpływu na decyzje podejmowane przez poszczególnych uczniów, którzy pragnęli wzorem jezuickich świętych i męczenników głosić Ewangelię wśród mieszkańców Indii, Chin oraz Japonii. Misje chrystianizacyjne, jak i dzieje oraz kultura krajów Dalekiego Wschodu interesowały wszak nie tylko uczniów kolegiów, ale o wiele szersze grono osób, chcących poszerzyć swoją wiedzą. Celom tym służyły polskie tłumaczenia autorów jezuickich, którzy w swoich dziełach opisywali Daleki Wschód. Ponadto wśród metod propagowania wiedzy niezwykle ważne miejsce zajmowały widowiska parateatralne i spektakle sceniczne, w których pojawiały się wątki orientalne. Zarówno one, jak i wspomniane działania translatorskie obejmowały swoim zasięgiem niezwykle szerokie grono osób, co w późniejszym czasie przełożyło się na znaczący wzrost zainteresowania Dalekim Wschodem, w konsekwencji zaś pojawieniem się mody na tzw. „chińszczyznę”. Celem niniejszego artykuł jest zatem prześledzenie wskazanych powyżej wątków, które – jak łatwo można zauważyć – pozostają w ciągu przyczynowo-skutkowym. W konsekwencji można zatem stwierdzić, że rola kolegiów jezuickich, jako ośrodków, z których wyszedł impuls propagowania wiedzy o krajach Dalekiego Wschodu wydaje się być niepodważalna. (shrink)

Modal Meinongianism is a form of Meinongianism whose main supporters are Graham Priest and Francesco Berto. The main idea of modal Meinongianism is to restrict the logical deviance of Meinongian non-existent objects to impossible worlds and thus prevent it from “contaminating” the actual world: the round square is round and not round, but not in the actual world, only in an impossible world. In the actual world, supposedly, no contradiction is true. I will show that Priest’s semantics, as originally formulated (...) in Towards Non-being, tell us something different. According to certain models, there are true contradictions in the actual world. Berto and Priest have noticed this unexpected consequence and have suggested a solution, but I will show that their solution is highly questionable. In the last section of this paper, I will introduce a new and simpler version of modal Meinongianism that avoids the problem. (shrink)

Saul Kripke pointed out that whether or not an utterance gives rise to a liar-like paradox cannot always be determined by checking just its form or content.1 Whether or not Jones’s utterance of ‘Everything Nixon said is true’ is paradoxical depends in part on what Nixon said. Something similar may be said about the sorites paradox. For example, whether or not the predicate ‘are enough grains of coffee for Smith’s purposes’ gives rise to a sorites paradox depends at least in (...) part on what Smith’s purposes are. If Smith’s purpose is to make some coffee to drink, so that he can wake up and start his day, then we would be inclined to accept, and would find it strange to deny the following sorites sentence. Je montrerai en premier lieu comment et pourquoi la sémantique formelle peut être employée comme un outil pour déterminer l’engagement ontologique d’une théorie : je soutiendrai d’une part que la sémantique doit être prise au sérieux comme apte à décrire la vérifaction des formules du langage; d’autre part, que les engagements ontologiques d’une théorie sont déterminés par ses vérifacteurs. De là, j’exposerai une méthode générale permettant, étant donné un certain type d’ontologie, de construire une sémantique dont les engagements ontologiques sont (...) en accord avec celle-ci. Pour cela, je définirai la notion de cadre ontologique : il s’agit d’une structure telle que toute sémantique cons-truite à partir de cette structure aura un certain engagement ontologique déterminé à l’avance. The origin of the notochord is one of the key remaining mysteries of our evolutionary ancestry. Here, we present a multi‐level comparison of the chordate notochord to the axochord, a paired axial muscle spanning the ventral midline of annelid worms and other invertebrates. At the cellular level, comparative molecular profiling in the marine annelids P. dumerilii and C. teleta reveals expression of similar, specific gene sets in presumptive axochordal and notochordal cells. These cells also occupy corresponding positions in a conserved (...) anatomical topology and undergo similar morphogenetic movements. At the organ level, a detailed comparison of bilaterian musculatures reveals that most phyla form axochord‐like muscles, suggesting that such a muscle was already present in urbilaterian ancestors. Integrating comparative evidence at the cell and organ level, we propose that the notochord evolved by modification of a ventromedian muscle followed by the assembly of an axial complex supporting swimming in vertebrate ancestors. Les discours sur la fin de l'histoire, dominants à la fin du siècle dernier, ont laissé place aux discours marquants la fin de la géographie, à l'urgence climatique et à l'effondrement. Ces considérations s'enracient dans l'histoire de la philosophie, chez Montesquieu en particulier. La mondialisation et les multiples crises (économique, sociale, politique et sanitaire) que nous traversons, nous imposent un nouveau questionnement pour nous resituer historiquement et géographiquement ; ces deux dimensions étant, de plus, inséparables.
